Estate Planning/Probate

Estate Planning can involve many different things, but typically encompasses the drafting of your will. A will is a document that allows you to direct where you want your property and money to go when you die. Importantly, if you have minor children, it also allows you to direct who should care for them should you and your spouse both die while they are still minors. Further it can allow you to place money for your children in trust to allow management by a responsible person, if you die before your children reach an age where you feel they will be responsible with managing money.

Estate planning also can include drafting Powers of Attorney, that will allow your spouse, or someone else that you choose, to manage your own financial affairs if you become temporarily or permanently unable to do so yourself. Taking care of this with drawing up a simple Power of Attorney will avoid the need for your spouse to go to court and ask a judge permission to manage your affairs.

Similar to a financial Power of Attorney is a medical Advance Directive, which will allow you to give your instructions to your doctors for end of life decisions, as well as appoint someone to make medical decisions for you if you are unable to do so.

Probate occurs when a loved one passes away and property needs to be retitled. This is also where creditors can file claims to get paid and where we can deny certain claims. With proper planning, probate becomes a simple process and we can walk you through that process.
